Summary of the Truly Agreed Version of the Bill

CCS HS HCS SS SCS SB 48 -- FAMILY CARE SAFETY REGISTRY

This bill makes various revisions to the Family Care Safety
Act.  In its major provisions, the bill:

(1)  Adds in-home care providers to the definition of
"elder-care providers";

(2)  Includes child-care providers, elder-care providers, and
personal-care providers to the definition of "employer";

(3)  Includes findings of financial exploitation of the elderly
or disabled from the Division of Aging and the Department of
Mental Health's Employee Disqualification List in the Family
Care Safety Registry beginning January 1, 2003;

(4)  Requires that personal-care workers hired after January 1,
2002, complete a registration form for the registry;

(5)  Requires the department to check for findings of financial
exploitation of the elderly or disabled, for criminal
convictions, and for inclusion on the Department of Mental
Health's Employee Disqualification List when a registration form
is submitted by a care provider;

(6)  Allows state-licensed care providers to receive information
from the registry immediately when requested;

(7)  Allows the Department of Health to use the registry for
licensing purposes;

(8)  Allows the Department of Mental Health to maintain an
employee disqualification list;

(9)  Allows the Department of Social Services to fund the Lakes
Area Child Assessment Center and the Southeast Missouri Child
Assessment Center;

(10)  Creates a Child Abuse, Custody and Neglect Commission
within the Governor's office;

(11)  Removes a child's racial and ethnic background from the
factors the Division of Family Services may consider in
determining subsidies; and

(12)  Allows the Office of Administration to promulgate rules
regarding certain contracts and bidding procedures.
